Terms of service — LearnSmart4Life

These terms govern your use of the LearnSmart4Life website and its free material, and the courses and products it lists (the “Service”). By using the site, placing an order or creating an account, you agree to them. LearnSmart4Life is part of a family of wellbeing brands created by Dr Alten du Plessis (alongside FlourishIQ, FlourishTalk and InspireWell4Life), and is powered by FlourishIQ. What it lists is bought on the site that owns it: courses on flourishiq.co.za, decks on flourishtalk.co.za and personal editions on inspirewell4life.com. FlourishTalk is the seller and processes card payments, so FlourishTalk is the name on your statement. Please also read our privacy policy and refund policy, which form part of these terms.

1. Your account and orders

Give accurate details and keep any login secure. You are responsible for activity under your account.
Accounts and personalised products are personal to you. Do not share your login, downloads or access with people who have not paid.
You must be old enough to enter a binding agreement in your country, or have the consent of a parent or guardian.

2. The free material

The LearnSmart Challenge, the Evidence Library and Staffroom view, the ThinkWell Practice Gym and the Everyday Knowhow taster are free to use, without an account. Each study in the Evidence Library remains the work of its authors; its full reference is on every card.
The LearnWell4Life videos are free to watch, and free to run with a class, a residence, an intake or a community group.
Week 1 of every Everyday Knowhow edition is free to read, without an account.

3. What is sold, and where

Courses are annual access per course, sold and delivered on FlourishIQ.
Decks are once-off purchases from FlourishTalk, delivered as personalised PDFs by email.
Personal editions are once-off purchases, or come with membership, from InspireWell4Life, delivered as personalised PDFs by email.
Everyday Knowhow passes open an edition (or all three) for a year from the day the code is first used. The email given at first use becomes the pass’s key; a pass is open on at most three devices at a time, and opening another device needs a number sent to that email. Each code is for one person: a code bought as a gift or for a class becomes the pass of whoever uses it first.
Stage tracks are three courses bought together on FlourishIQ with its 20% off any three; each course follows the course terms.
Class and intake packs and group orders are course seats ordered on FlourishIQ’s group-order page at its per-learner prices. Institution editions, and decks and editions for a group, are quoted per group.
Each purchase also follows the terms of the site that sells it: FlourishIQ, FlourishTalk or InspireWell4Life.
We may add, update, retire or re-organise products and tools over time.

4. Prices and payment

Prices are shown on the relevant page; the price you pay is the one shown at checkout on the owning site. Prices may change from time to time.
Card payments go through PayFast and are processed by FlourishTalk, the name on your statement. Prices are in South African rand.
Refunds follow our refund policy.

5. Licence and fair use

When you buy a product or take a course, you receive a personal, non-transferable, non-exclusive licence to use it for your own learning and teaching. You may not:

copy, resell, sub-license, publish or redistribute the content;
share your account, downloads or access with people who have not paid;
use the Service unlawfully, or try to disrupt it or gain access you are not entitled to.

6. Intellectual property

The content, tools, the selection and summaries of the Evidence Library, the artwork, designs and branding are owned by LearnSmart4Life and its creator, Dr Alten du Plessis (and, where applicable, Stellenbosch University), and are protected by law. LearnWell™ and LearnWell4Life™ were created by Dr Alten du Plessis. These terms do not transfer ownership to you.

7. Your content

What you write in a course’s tools remains yours. You give us the limited permission needed to store it, show it back to you and run the Service. What you write in the ThinkWell Practice Gym stays in your own browser and never reaches us.

8. Education, not medical or clinical advice

LearnSmart4Life provides educational, evidence-informed content on learning, thinking and teaching. It is not therapy, counselling or medical advice, and it is not a substitute for professional care. If you are struggling, in distress or have a health concern, please consult a qualified professional or your local emergency services.

9. Affiliates

If you take part in the family affiliate programme, the affiliate terms also apply.

10. Disclaimers and limits of liability

We work hard to provide a reliable, high-quality Service, but we provide it “as is” and cannot guarantee particular outcomes or uninterrupted availability. To the extent the law allows, our liability arising from your use of the Service is limited to the amount you paid for the product or course concerned in the 12 months before the claim.

11. Suspension and ending

You may stop using the Service at any time. We may suspend or close an account that breaches these terms or is used unlawfully. Where you have paid for access and have not breached these terms, we will honour the access you paid for.

12. Governing law

These terms are governed by the laws of the Republic of South Africa.

13. Changes

We may update these terms from time to time. The date at the top shows the current version; continuing to use the Service means you accept the current terms.
